Clergy Disciplinary Tribunal
The Church of England, by the Clergy Discipline Measure, 2003, sought to clarify the disciplinary procedures for clergy, setting up Clergy Disciplinary Tribunals. The Measure, and the Codes of Practice and Rules of Procedure which accompany it, created a clear disciplinary code and a modern procedure for the investigation of complaints. The first Disciplinary Tribunal (relating to a priest from the Diocese of York), has recently sat, and following an appeal, the proceedings have concluded. The priest was represented by John Lodge of Park Court Chambers.
Whilst some knowledge of the workings of the Church of England is useful (John is the Churchwarden of the church where he worships and the son of a priest), the disciplinary procedure in such cases is similar to that of other professions. An ability to present a case to a Tribunal consisting of lawyers, clergy and lay people is essential along with a detailed knowledge of pre-trial issues such as disclosure. Park Court Chambers has considerable expertise in disciplinary procedures, members frequently appearing before the GMC, in Police Disciplinary Hearings and representing teachers and carers accused of misconduct in the course of their employment. Clergy Disciplinary Tribunals can now be added to this list.
