Robert Smith QC secures acquittal of Emmerdale Star
Robert Smith QC secured the acquittal on Monday of this week of Emmerdale star, Lewis Linford, charged with indecent assault in a Hull nightclub.
Instructed by Freeman and Co of Manchester, the jury took just 7 minutes to return a verdict of acquittal after hearing evidence from the Complainant and a man she had been with in the Club and after hearing evidence from the defendant and the male friend he was with who was a Marine Engineer with Maersk Line. The prosecution case was that the Complainant had been queuing at an ATM machine in Pozition night club in Hull when Lewis had assaulted her boy friend and then indecently assaulted her and gone on to physically assault another girl.
The prosecution suggested that Lewis had been intoxicated. The allegations were demonstrated to be without foundation and the defence submitted that the Complainant had told six significant lies in her account to the Police. In particular the Police who attended the Club afterwards did not suggest that the defendant was in any way affected by drink and the Complainant was shown to have left the Club, claiming to have gone home. When the Police arrived at her address there was no reply. The Complainant's boyfriend did not support her account in a number of important respects despite the fact that he had been present at the time of the alleged indecency and Lewis's companion gave clear evidence that the allegations were entirely false. During the altercation the Complainant had punched Lewis in the face a number of times. It transpired at the hearing that she had described herself as "Hull's first female boxer".
Following the verdict Mr Freeman told the Press that he considered that the law should be changed - preserving anonymity for defendants as well unless they were in due course convicted. There has been a huge amount of support for Lewis in the national Press following the verdict.
