These linked cases concerned the decision of the defendant Basildon District Council to proceed with direct action to evict the claimants (Irish Travellers) from land they owned but which they had developed as residential sites in breach of planning permission. Alex Offer represented the claimants in McCarthy & Others and Culligan & Others, claims which together encompassed the entirety of the well known “Dale Farm” site in Basildon.
Mr Justice Collins gave judgment for the claimants and quashed the Council’s decisions. For further information click here.
