The 2007 Park Court Chambers Family Team comprises 19 committed Family Law Practitioners who offer both strength and depth in their expertise.

CASES INVOLVING CHILDREN

Specialists practise in PUBLIC LAW encompassing all aspects of care law including adoption, with an emphasis on serious injury and abuse and complex medical evidence.

Wide PRIVATE LAW experience includes acting in difficult contact and international relocation cases and proceedings for the recovery of a child from Hague and non-Hague Convention countries.

RECENT IMPORTANT CASES INVOLVING CHILDREN

  • Birmingham City Council v LR (Court of Appeal: Lord Justice Thorpe, Lord Justice Tuckey and Lord Justice Wall). (2006) EWCA Civ 1748 . Provisions relating to notice and leave in section 14 A of the Children Act 1989 as well as the Special Guardianship Regulations 2005 were considered.
  • H v W (Court of Appeal: Lord Justice Thorpe, Lord Justice Wall and Lord Justice Thomas). Judgment handed down on 8.2.07. This case looked at the guidelines on international relocation cases as set out in Payne and Payne (2001) 1 FLR 1052
  • Leeds City Council and Others v Channel Four Television Corporation Family Division Munby J 6.7.05 January (2007) Family Law, (2007) FLR forthcoming: Urgent application for injunctive relief was brought before the court. Channel Four proposed to broadcast a film the following evening.

ANCILLARY RELIEF AND CASES INVOLVING COHABITANTS - TRUSTS OF LAND AND APPOINTMENT OF TRUSTEES ACT 1996 (TLATA)

Ancillary relief

Practitioners specialise in all aspects of matrimonial property and finance and represent parties throughout the litigation process, from First Appointment through to Financial Dispute Resolution and up to Final Hearing, advising on evidence and offers of settlement, and acting in applications involving third parties, such as those brought under section 37 of the Matrimonial Causes Act 1973.

We have considerable experience in cases involving farms of all types and sizes and small family companies. We are familiar with the difficulties which arise when assets have been put in trust.

Cohabitation and Law of Trusts

Members of the team have experience in acting in the County Court and High Court in final hearings on behalf of cohabitants concerning the determination of beneficial interests in property and other assets; and financial provision for children. In addition to applications brought under s 14 of TLATA, members of the team also have experience of claims involving applications brought under Schedule 1 of the Children Act 1989.
